1. Purpose and acceptance
These Terms and Conditions of Use ("Terms") govern access to and use of the BookVerse application, website and related services (the "Service"), provided by Alessio Occulto ("BookVerse", "Nooksoft", or the "Provider").
By creating or using a Nook Account to access BookVerse, the user agrees to these Terms and acknowledges the BookVerse Privacy Policy. If the user does not agree to these Terms, they must not use BookVerse.
Nothing in these Terms limits rights that cannot lawfully be excluded or restricted, including mandatory rights available to consumers under applicable EU and national law.
2. BookVerse and Nook Account
BookVerse is part of the Nooksoft ecosystem. Authentication is provided through Nook Account, the centralized identity and authentication system operated by Nooksoft.
These Terms govern the use of BookVerse. Account-level actions, including credential security, global account deactivation and deletion of the underlying Nook Account, apply at Nook Account level and therefore affect products that use that identity.
3. Requirements for use
BookVerse is available only to users who are at least 16 years old. The 16-year threshold is a BookVerse eligibility requirement and applies independently of lower statutory consent thresholds that apply to specific processing activities.
To use BookVerse, the user must:
- meet the minimum age requirement;
- provide accurate and reasonably up-to-date registration information;
- have the legal capacity required to enter into these Terms under applicable law;
- use the Service in accordance with these Terms and applicable law.
4. Registration and account security
A Nook Account is personal and must not be transferred, sold or shared in a way that compromises account security. The user is responsible for taking reasonable steps to protect their credentials.
The user must not:
- impersonate another person or organization;
- create accounts for fraudulent, abusive or deceptive purposes;
- attempt to bypass authentication, moderation, rate limits or other security controls;
- use stolen credentials, session tokens or other unauthorized authentication material;
- interfere with the availability, integrity or security of BookVerse or Nook Account.
BookVerse records security-relevant login information and sends login-security notifications as described in the Privacy Policy. Users must promptly report suspected unauthorized access to support@bookverse.tech.
5. User-generated content
Users can create or publish reviews, ratings, booklists, profile information and other content supported by BookVerse ("User Content").
The user remains responsible for their User Content and represents that they have the rights or other lawful basis necessary to submit it.
For as long as User Content is stored or displayed through BookVerse, the user grants the Provider a non-exclusive, worldwide, royalty-free license limited to what is reasonably necessary to host, store, reproduce, format, display, transmit, moderate and technically operate that content within the Service.
This license does not transfer ownership of the user's original content to BookVerse and ends when the content is deleted, except where limited continued processing is required by law, security, dispute handling, backups or other legitimate purposes described in the Privacy Policy.
6. Book, library and event proposals
Users can submit proposals for books, libraries and events to improve the BookVerse catalogue. Submission creates no entitlement to acceptance, publication or attribution.
BookVerse reviews, corrects, normalizes, merges, rejects and removes catalogue proposals as necessary to maintain catalogue quality, avoid duplicates and comply with applicable law.
Accepted factual catalogue information remains part of the BookVerse catalogue after deletion of the submitting user's account where the information is retained as catalogue data and personal attribution is removed or otherwise handled in accordance with the Privacy Policy.
The user must not submit copyrighted descriptions, images, photographs or other protected material unless they have the necessary rights or authorization to do so.
7. Prohibited content and conduct
Users must not use BookVerse to create, upload, publish, transmit or promote:
- illegal content or activity;
- harassment, credible threats, stalking or targeted abuse;
- hate speech or unlawful discriminatory content;
- defamatory content or unlawful invasions of another person's rights;
- content that infringes copyright, trademarks or other intellectual-property rights;
- personal data of third parties where publication is unlawful or unnecessary;
- spam, scams, deceptive behavior or unauthorized commercial communications;
- malware, credential theft, malicious code or attempts to compromise the Service;
- content or behavior intended to evade moderation or technical restrictions;
- content that unlawfully encourages violence, criminal activity or dangerous conduct.
Context matters. BookVerse considers the nature, severity, frequency, intent and likely impact of conduct when deciding whether and how to act.
8. Moderation, reports and review of decisions
BookVerse moderates User Content and account activity to enforce these Terms, protect users and systems, comply with legal obligations and maintain catalogue and community integrity.
Moderation is based on human administrative review. Automated controls support technical detection, prioritization, rate limiting and abuse prevention; significant moderation decisions are not based solely on automated decision-making.
8.1 Reporting content
Users and other persons report potentially illegal or Terms-violating content electronically at support@bookverse.tech. A report must identify the specific content, state the reason for the report and provide sufficient information for BookVerse to assess it.
8.2 Moderation measures
Depending on the circumstances, BookVerse applies measures proportionate to the circumstances, including:
- taking no action after review;
- warning the user;
- editing or rejecting a catalogue proposal;
- removing or restricting access to User Content;
- temporarily suspending access to BookVerse or another affected product;
- imposing a product ban without an automatic expiry date;
- restricting or terminating a Nook Account in exceptional cases involving serious security, legal or ecosystem-wide abuse.
8.3 Reasons and review
BookVerse provides the affected user with a clear and specific reason for a content-removal, suspension, ban or comparable moderation decision when electronic contact details are available and applicable law requires a statement of reasons. The notice identifies the relevant contractual rule or legal ground and the available review channel.
A user who contests a moderation decision submits a review request to support@bookverse.tech. BookVerse assesses review requests diligently, objectively and without arbitrariness. Statutory complaint, judicial and out-of-court redress rights under applicable law remain unaffected.
9. Social features and booklists
BookVerse provides user profiles, following and follower relationships, likes, reviews, booklists and wishlists. Information designated as public through these functions is visible to other users according to the applicable visibility rules.
Users must use social features respectfully and must not use follows, likes, reviews, lists or profile fields to harass others, manipulate metrics, send spam or evade moderation.
10. Personal library and loans
BookVerse allows users to organize books into supported reading states and lists. BookVerse records information about books lent to or borrowed from other users through its loan-management functions.
11. Bion — AI-based assistant
Bion is the BookVerse artificial-intelligence reading assistant. It generates conversational responses from the BookVerse AI service and operates under the processing rules stated in the Privacy Policy.
The user acknowledges that:
- Bion can generate incorrect, incomplete, misleading or outdated information;
- Bion output does not constitute professional legal, medical, financial or other regulated advice;
- users should independently verify important information before relying on it;
- users should not provide unnecessary personal data, special-category data or confidential third-party information to Bion.
The processing of Bion conversations is described in the Privacy Policy. The availability of Bion or particular model versions is not guaranteed.
12. Location, country and map features
BookVerse location functions use country, approximate location and precise device location as described in the Privacy Policy.
Precise device location used for nearby libraries, events or map features is subject to the user's device permissions. If location permission is denied or revoked, location-dependent features are unavailable or less accurate.
Map, library and event information can be incomplete, outdated or inaccurate. Users must verify important real-world information, including opening hours, accessibility, addresses and event details, directly with the relevant venue or organizer.
13. Service availability, maintenance and functional changes
BookVerse aims to provide the Service with reasonable care but does not guarantee uninterrupted availability or the absence of bugs, outages or compatibility issues.
BookVerse performs maintenance, security updates, technical modifications and functional changes that are necessary to operate, secure and develop the Service. Temporary interruption is permitted where required by maintenance, security, incident response or legal compliance.
Where mandatory consumer law requires notice, continued conformity, remedies or a right to terminate because of a material modification of a digital service, those statutory rights remain fully applicable.
14. Intellectual property
The BookVerse and Nooksoft software, branding, interfaces, original graphics, logos and other proprietary elements belong to the Provider or their respective rights holders and are protected by applicable intellectual-property law.
Except where permitted by mandatory law or expressly authorized, users must not:
- copy, redistribute or create unauthorized derivative works from proprietary elements of the Service;
- reverse engineer or circumvent technical protections beyond what applicable law expressly permits;
- use BookVerse or Nooksoft names, logos or trademarks in a misleading manner;
- scrape, extract or systematically reproduce substantial parts of the Service or catalogue in violation of applicable rights or technical restrictions.
15. Third-party content and services
BookVerse displays and links to information supplied by users, catalogue sources, libraries, event organizers and other third parties. Unless expressly stated otherwise, BookVerse does not control those third parties and does not guarantee the accuracy, availability or continued existence of their content or services.
Technical providers used to operate BookVerse, such as hosting and email-delivery providers, are described where relevant in the Privacy Policy. Their role in technical processing does not make them parties to the contract between the user and BookVerse.
16. Product restrictions and account enforcement
16.1 Temporary suspension
A temporary suspension blocks access to one or more specified Nooksoft products for a defined period. Every suspension has an expiry date. On expiry, the restriction ceases to apply, subject to successful authentication and any separate active restriction.
16.2 Product ban
A product ban restricts access to the affected product without an automatic expiry date. It remains effective until removed following administrative review or another applicable process.
16.3 Multiple products
The same Nook Account can be suspended or banned from multiple products at the same time. Restrictions are enforced according to the product(s) identified in the moderation decision.
16.4 Serious account-level action
Where serious security abuse, fraud, unlawful conduct, legal obligations or ecosystem-wide abuse justify account-level action, the Provider is entitled to restrict, deactivate or terminate the underlying Nook Account, subject to applicable law, necessity and proportionality.
17. Self-service account deletion and 14-day recovery period
The user can initiate deletion of the Nook Account through the self-service account-deletion functionality in BookVerse.
Self-service deletion is not immediate. After a valid request:
- the Nook Account is marked as pending deletion;
- current sessions and refresh tokens are revoked for security;
- a deletion deadline is scheduled for 14 days after the request;
- the user's data remains stored during this recovery window so that the deletion can be cancelled.
If the user successfully signs in again with their Nook Account credentials through any Nooksoft product before the 14-day deadline, the pending deletion request is automatically cancelled and the account continues to operate normally.
A refresh token or an already-open session does not by itself cancel deletion; recovery requires a new successful authentication.
Once the 14-day deadline has passed, the self-service recovery period ends. The account can no longer be restored through login and is queued for permanent deletion in accordance with the Privacy Policy and applicable retention obligations.
Because deletion concerns the underlying Nook Account, permanent deletion terminates access through that identity to BookVerse and every Nooksoft product that depends on the same account.
18. Liability and mandatory statutory rights
To the extent permitted by applicable law, the Provider is not responsible for losses caused solely by circumstances outside its reasonable control, misuse of the Service by the user, inaccurate third-party or user-supplied information, or private arrangements between users.
BookVerse does not guarantee that Bion, catalogue information, reviews, event information or other informational features are complete or error-free.
- liability that cannot lawfully be excluded;
- liability for willful misconduct or gross negligence where such limitation would be unlawful;
- mandatory consumer rights, including statutory remedies relating to digital content or digital services;
- rights arising under data-protection, product-safety or other mandatory law.
19. User responsibility for unlawful use
Users are responsible for their own unlawful or Terms-violating conduct and for content they submit. To the extent permitted by applicable law, a user is responsible for direct losses caused to the Provider or third parties by intentional or negligent unlawful conduct.
This clause does not create an indemnity obligation broader than what is permitted under mandatory consumer law and does not waive any statutory defence available to the user.
20. Service, security and administrative communications
BookVerse sends communications reasonably necessary to operate the Service, including account verification, password reset, login-security alerts, moderation or restriction notices, account-deletion notices, privacy/Terms updates, support responses and significant service information.
BookVerse does not currently use the Nooksoft administrative email tools to send marketing or promotional email to users.
Users are responsible for maintaining a valid email address associated with their Nook Account. Email delivery cannot be guaranteed where the user's provider blocks, filters or rejects a message.
21. Changes to these Terms
The Provider revises these Terms for legal, security, technical and functional reasons permitted by the contract and applicable law. Significant changes are communicated clearly through the Service, email or another durable channel where required.
Express acceptance is obtained where applicable law or the nature of the amendment requires it. A modification that negatively affects access to or use of the digital service beyond a minor extent remains subject to the consumer rights established by Directive (EU) 2019/770 and its national implementation, including the applicable termination right.
The version displayed on this page, identified by its version number and effective date, is the applicable public version.
22. Governing law and disputes
These Terms are governed by Italian law, without prejudice to mandatory protections available to consumers under the law of their country of habitual residence within the European Union or other applicable mandatory law.
For users who qualify as consumers, jurisdiction is determined by mandatory consumer-protection rules. Nothing in these Terms requires a consumer to bring a dispute before a court other than the court competent under applicable mandatory law.
Before starting formal proceedings, users are encouraged, but not required, to contact support@bookverse.tech so that BookVerse can attempt to resolve the issue.
23. Final provisions
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain effective to the maximum extent permitted by law.
A failure by the Provider to enforce a provision on one occasion does not constitute a permanent waiver of that provision or any other right.
Section headings are provided for readability and do not limit the meaning of the provisions.
